Elevate Performance AI LLC (“Elevate Performance AI,” “we,” “us,” or “our”) operates ClearPath, a revenue-operations platform for field sales teams (“ClearPath,” the “Platform,” or the “Service”). This Privacy Policy describes how we collect, use, store, and protect information when you use ClearPath.
This policy describes ClearPath as it exists today. It will be updated as the Platform’s features change.
1. Information We Collect
We collect the following categories of information from users of ClearPath:
Account information:first name, last name, email address, organization affiliation, and role (e.g., field representative, manager) provided when you sign in or are added to an organization’s ClearPath workspace.
Voice and call data: audio recordings you submit through the Voice Debrief feature, along with the transcripts and AI-generated summaries, signals, and recommendations derived from them.
Account and activity data: information about the sales accounts you manage within ClearPath, including account names, specialty/vertical classification, pipeline stage, stage history, and related activity you or your organization enters into the Platform.
Usage data:records of your interactions with ClearPath’s AI features, including which prompts were used, model responses, and related metadata, for the purpose of operating and improving the Service.
Authentication data: ClearPath uses passwordless, magic-link email authentication. We do not store passwords.
2. How We Use Information
We use the information described above to:
• Operate the ClearPath Platform, including generating AI-assisted call preparation, transcribing and analyzing Voice Debrief recordings, and maintaining your organization’s account and pipeline data.
• Maintain the security, integrity, and tenant isolation of the Platform.
• Communicate with you about your account and the Service.
• Diagnose and fix technical issues.
We do not sell your personal information, and we do not use your organization’s account or call data to train AI models on behalf of any party other than to operate the Service you have engaged us to provide.
3. Third-Party Service Providers
ClearPath relies on the following third-party providers to operate. Each processes a limited scope of data solely to provide their respective service to us:
• Supabase — database hosting, authentication, and file storage.
• Anthropic — AI language processing for call preparation and coaching features.
• OpenAI — audio transcription and AI signal extraction from Voice Debrief recordings.
• Vercel — application hosting.
• Twilio— SMS delivery. As of this policy’s effective date, ClearPath’s use of SMS is limited to internal operational notifications for Elevate Performance AI personnel and does not involve sending SMS messages to platform users or customers. We separately collect SMS opt-in preferences (see Section 3a) in preparation for a future user-facing SMS feature; no such messages are sent today.
3a. SMS Communications and Consent
If you voluntarily provide your mobile phone number and opt in via our SMS consent form, we store your name, email address, phone number, the exact consent language you agreed to, the date and time of your consent, and the page you submitted it from. This information is used solely to determine whether and how we may contact you by SMS for account alerts and task reminders. You may withdraw consent at any time by replying STOP to any message you receive, or by contacting us using the information in Section 11.
SMS opt-in data and consent will not be shared with third parties or affiliates for marketing or promotional purposes.
4. Data Security
ClearPath enforces row-level security so that each organization’s data is isolated from every other organization’s data. Data is encrypted in transit. Access to sensitive administrative functions is restricted and logged. No security measure is perfect, and we cannot guarantee absolute security, but we are committed to protecting your information using industry-standard practices appropriate to the data we hold.
5. Your Responsibilities
You are responsible for maintaining the confidentiality of your ClearPath sign-in access, for the accuracy of information you submit to the Platform, and for ensuring you have the necessary rights and permissions to submit any call recordings, account information, or other data you provide through ClearPath.
6. Data Retention
We retain account, call, and activity data for as long as your organization maintains an active ClearPath subscription, and for a reasonable period afterward as needed for legitimate business, legal, or archival purposes.
7. Intellectual Property
The ClearPath Platform, including its software, design, and underlying technology, is the property of Elevate Performance AI LLC. Data you or your organization submit to ClearPath (account information, call recordings, notes, and related content) remains your property. By using the Service, you grant Elevate Performance AI a limited license to process that data solely to provide the Service to you.
8. Limitation of Liability
ClearPath is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Elevate Performance AI LLC disclaims all warranties, express or implied, and shall not be liable for indirect, incidental, special, or consequential damages arising from your use of the Platform.
9. Governing Law
This Privacy Policy is governed by the laws of [STATE OF INCORPORATION], without regard to its conflict-of-laws principles.
10. Changes to This Policy
We may update this Privacy Policy as ClearPath evolves. Material changes will be reflected by updating the effective date above. Continued use of the Platform after a change constitutes acceptance of the revised policy.
