Terms of Service

These Terms of Service (“Terms”) govern your access to and use of ClearPath (the “Platform” or the “Service”), provided by Elevate Performance AI LLC (“Elevate Performance AI,” “we,” “us,” or “our”). By accessing or using ClearPath, you agree to these Terms.

1. The Service

ClearPath is a revenue-operations platform for field sales teams. It provides AI-assisted call preparation, voice-based call debriefing and transcription, account and pipeline tracking, and related coaching and workflow features for authorized users of a subscribing organization.

2. Accounts and Access

Access to ClearPath is granted through your organization and authenticated via a passwordless email sign-in link. You are responsible for maintaining control of the email account used to access ClearPath and for all activity that occurs under your account. You may only use ClearPath for the organization that has authorized your access, and only in the role assigned to you.

3. Acceptable Use

You agree to use ClearPath only for legitimate business purposes related to your organization’s sales operations. You agree not to: attempt to access data belonging to another organization; attempt to circumvent the Platform’s access controls or security measures; upload content you do not have the right to submit (including call recordings made without appropriate consent under applicable law); or use the Service in any way that violates applicable law.

4. Voice Recordings and AI Features

ClearPath’s Voice Debrief feature transcribes and analyzes audio recordings you submit using third-party AI providers. You are solely responsible for ensuring that any call or conversation you record and submit to ClearPath complies with all applicable recording-consent laws in your jurisdiction. AI-generated summaries, signals, and recommendations are provided to assist your workflow and are not guaranteed to be complete or error-free; you remain responsible for your own business decisions.

5. SMS Communications

As of this policy’s effective date, ClearPath’s use of SMS messaging is limited to internal operational notifications used by Elevate Performance AI personnel. ClearPath does not currently send SMS messages to platform users as part of the Service.

6. Intellectual Property

Elevate Performance AI LLC retains all right, title, and interest in and to the ClearPath Platform, including its software, design, and underlying technology. Data you or your organization submit to ClearPath remains your property. You grant Elevate Performance AI a limited license to process that data solely to provide the Service to you.

7. Termination

We may suspend or terminate your access to ClearPath if we reasonably believe you have violated these Terms. Your organization may also request removal of a user’s access at any time.

8. Disclaimer of Warranties

ClearPath is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

9. Limitation of Liability

To the fullest extent permitted by law, Elevate Performance AI LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from or related to your use of ClearPath.

10. Governing Law

These Terms are governed by the laws of [STATE OF INCORPORATION], without regard to its conflict-of-laws principles.

11. Changes to These Terms

We may update these Terms as ClearPath evolves. Material changes will be reflected by updating the effective date above. Continued use of the Platform after a change constitutes acceptance of the revised Terms.
